Probate & Trust Administration

Administer the Estate of a Loved One with Dignity

We Have Been Helping Families for More Than 15 Years

Laura

Probate and trust administration can be difficult and tedious processes that need to be dealt with at what is likely a very difficult time in your life. If you have recently lost a loved one, it is important to make sure that their wishes are respected and that their estate or trust is administered properly. Whether a complete estate plan is in place, or your loved one passed away without a Will or trust, an experienced lawyer can help to ensure that any assets are distributed properly and in conformity with the applicable statutes, and that taxes and other administration expenses are kept to a minimum.

At Henninger & Henninger, LLC, the job of our firm is to walk the personal representative of a Decedent’s estate or the trustee of a trust through everything that they will need to know and do to complete the probate process or to administer the trust. This includes the sale of property and other assets, the filing and payment of applicable taxes, the distribution of property to beneficiaries, and the preparation and filing of any required accountings. When necessary, attorney Laura Henninger will also represent clients in probate court.

Estate Administration in Bel Air, Maryland

If you have been appointed as personal representative of a loved one’s estate, you may be confused or apprehensive about the probate process. Henninger & Henninger, LLC, can assist you with initiating the probate process with the Register of Wills for the county in which the Decedent resided. The job of the personal representative is to locate the assets of the Decedent, manage those assets, and distribute them to the beneficiaries according to the Decedent’s Will, or in accordance with the statutes of Maryland, if the Decedent did not have a Will. Along the way, there are important steps to be taken, certain guidelines to be followed, and various probate documents and tax returns to be filed. At Henninger & Henninger, LLC, we will help you make this process as efficient as possible, while keeping the process in line with the applicable probate laws and tax laws.

Trusts can be established for many different reasons and to achieve many different purposes. Some trusts are established by clients during their lifetimes, and others come into existence upon the client’s passing. Regardless of the type of trust or the circumstances of its creation, the Trustee has a fiduciary duty to the beneficiaries of the trust to act in the beneficiaries’ best interests. There are many rules to be followed and reporting requirements that must be met, including the filing of tax returns. Laura Henninger has helped many Trustees to fulfill their fiduciary duties and to manage their trusts in an efficient, tax-effective and fair manner.
